Using and attributing photos published in PlantVillage website

PlantVillage    Kuala Lumpur

I intend to use some photos for my forthcoming book on agriculture, listing some common diseases and pests of cabbage as given in the link https://www.plantvillage.com/en/topic... . I enquired and received a reply from Mr. David Hughes (posted Sep 11) as follows:
"All content on PlantVillage is available under the Creative Commons Attribution-ShareAlike License; this means that you are free to share and remix everything you find here, even for commercial purposes, as long as you share the results under the same license."
However, when clicking on several of the photos, they are classified as Creative Commons Attribution Non commercial. I would need reconfirmation that these photos indeed may be used, if I intend to sell my book if they are published.

You are right - you cannot use all content on PlantVillage for commercial purposes. Our Terms of Service https://www.plantvillage.com/tos specify (point 8, paragraph b, section I):

PlantVillage Content: All Content (other than computer software) made available by PlantVillage on the websites, apps or services is licensed under the Creative Commons Attribution-ShareAlike 3.0 License, unless marked otherwise.

(emphasis mine).

In other words, please always check the copyright of a particular image - it may have a specific copyright license that was given to it by the original creator of the image, not by PlantVillage. Our license applies if and only if nothing else about a license is noted.

However, reading the given link on point 8 paragraph b section I and section ll, the contents seem to contradict each other, ie. all materials submitted by Licencor to PlantVillage will be under Share-alike but yet section I carries exceptions. Your kind clarifications would be appreciated.

Section I is general, and simply says that unless stated otherwise, the license is Creative Commons Attribution-ShareAlike 3.0. Section II is specific about content uploaded by users, which has to have either no copyright, or Creative Commons Attribution-ShareAlike 3.0 - otherwise it cannot be uploaded to PlantVillage. In other words, by section II, all user-generated content will be Creative Commons Attribution-ShareAlike 3.0 by PlantVillage. This means that per section II, you are free to use any user-uploaded content commercially (as long as you license it under the same license), and per section I, you are also allowed to use any non-user-generated content commercially (as long as you license it under the same license), if it doesn't already have another license. The two or thus not contradictory.

Thank you for your clarification on licensing pertaining
to user-uploaded contents and non-user uploaded contents. My understanding is that all user-uploading contents should be under section II, meaning free to be used, including for commercial purposes. But the photos in the link mentioned by me are uploaded by users but many are under NC licensing and this is what I cannot reconcile from Section II and your kind explanation.
Nevertheless, if remains doubtful, I will desist from using them.

The photos in th link mentioned by you are not user-uploaded; we created this pages, and we keep maintaining them. User uploaded images are only in the forum, the user pages, and the the plant journals.
